What are some of the department’s most satisfying successes of the past year and why? We are extremely satisfied to have been able to partner with our clients and help them address the unprecedented challenges that arose over the past year and a half. These included not just high-stakes litigations, but also challenging questions regarding employee health and wellness, discrimination and inclusion, remote working, real estate, and overall crisis response, among many others. We are encouraged by our clients’ resilience, and remain eager to work with them again in a more stable environment.

Against this backdrop, we won a number of billion-dollar results that showcase our institutional strengths in corporate and securities law, restructuring, antitrust, and IP, as well as our cross-disciplinary trial and appellate expertise. We won a unanimous Supreme Court victory, following telephonic arguments, in a case that broke new ground in Foreign Sovereign Immunities Act jurisprudence. We secured a complete victory in a significant Delaware deal dispute that was one of the first to address the impact of COVID-19 in the corporate context and that charted new territory in MAE jurisprudence. And, we developed a novel strategy under a rarely used bankruptcy code provision to resolve a massive, multi-state environmental liability and secure plan confirmation. Meanwhile, on appeal: We sustained a complete $800 million defense jury verdict we won in an antitrust class action—which never go to trial; we upheld a summary judgment win in a $3 billion copyright dispute; and we won an important Delaware Supreme Court victory that upholds important principles of arbitration award finality.
