Earth Rated was hit with a consumer class action Thursday in New York Eastern District Court over its compostable dog poop bags. The suit, brought by Bursor & Fisher, accuses the defendant of deceptive marketing by labeling its products as 'certified for home composting' while having small print disclaimers on the package stating that the bags should only be disposed of at commercial composting facilities. Counsel have not yet appeared for the defendant. The case is 1:21-cv-05994, Natale et al. v. Earth Rated.
