Albany County Sheriff Craig Apple on Friday said he was "caught by surprise" when a criminal summons charging former Gov. Andrew Cuomo with misdemeanor forcible touching was issued by an Albany City Court judge just a few minutes after investigators from the sheriffs' office submitted their findings for review.
