On Dec. 23, 2021, President Biden signed the Uyghur Forced Labor Prevention Act (the Act), which was passed earlier in December with overwhelming bipartisan support in both the House and Senate.

The Act creates a rebuttable presumption that all goods, wares, articles, and merchandise that have been mined, produced, or manufactured wholly or in part in the Xinjiang Uyghur Autonomous Region of the People's Republic of China have been mined, produced, or manufactured wholly or in part by forced labor. As a result, unless the presumption can be rebutted, the importation of all such goods into the United States will be prohibited by §307 of the Tariff Act of 1930, which prohibits the importation of goods made with forced labor.
