Plaintiff suffered a serious injury when his hand got caught in a log splitter that he and third-party defendant, his son, were using on property jointly owned by defendant Moffitt and Jorgensen, a member of defendant Triple J Vending LLC.

Plaintiff had performed landscaping work on the property for 15 years prior to the date of the incident. The landscaping work performed at the property including mowing the lawn, gardening, cutting down trees, and other farm work.
