Petitioner brought a petition seeking a determination of parenthood based on a “plan to adopt and raise a child together” with respondent. However, after the parties separated, the court found that their plan to adopt and raise a child together abated with their separation.

The decision was sustained on appeal, but the Appellate Division remanded to the trial court for a determination of the petition on the unpleaded grounds of equitable estoppel. On remand, the instant court denied the petition to determine parenthood by equitable estoppel, noting that petitioner absented herself from most subsequent court proceedings.
