U.S. Senior District Judge William Kuntz of the Eastern District of New York on Monday rejected motions for a new trial from two men convicted of the 2017 killing of a Queens business owner, finding that the men were not deprived of their right to a fair trial when Kuntz decided to exclude unvaccinated people from the jury.

"[Ppassim] Elder and [Wilbert] Bryant killed one man," Kuntz wrote. "This Court declines to let them add one or more jurors to their body count."
