The convicted defendants "killed one man," Senior U.S. District Judge William Kuntz wrote. "This Court declines to let them add one or more jurors to their body count." Defense counsel argued in post-verdict motions that excluding unvaccinated persons resulted in a racially-skewed jury.

U.S. Senior District Judge William Kuntz of the Eastern District of New York on Monday rejected motions for a new trial from two men convicted of the 2017 killing of a Queens business owner, finding that the men were not deprived of their right to a fair trial when Kuntz decided to exclude unvaccinated people from the jury.
"[Ppassim] Elder and [Wilbert] Bryant killed one man," Kuntz wrote. "This Court declines to let them add one or more jurors to their body count."
