A lawsuit filed by a Queens man who was injured when he was thrown from his bike while New York City Police Department officers pursued him in an unmarked car for a moving violation— which was captured in shocking surveillance camera footage—may go before a federal jury.

Ruling in a case that has involved more than five years of litigation, U.S. District Court Judge Nina Gershon of the Eastern District denied motions for partial summary judgment filed by attorneys for plaintiff Heins Rodriguez and the city’s Law Department, finding that questions of fact remain as to whether NYPD officer Zheng Zuopeng, who was behind the wheel of the police vehicle when Rodriguez was flung from his bike, was intentional in his conduct.
