The U.S. Court of Appeals for the Second Circuit on Tuesday upheld the dismissal of a defamation lawsuit over Planned Parenthood Federation of America’s response to surreptitious recordings that landed an anti-abortion activist and his associate under criminal indictment in California.

The nine-page summary order, from a panel of the Manhattan-based appeals court, affirmed the ruling of a lower court judge, who last year decried anti-abortion activist David Daleiden’s suit as “in a word, ridiculous.”
