The title above requires some explanation and background. On Dec. 29, 2020, the Chief Administrative Judge signed Administrative Order 270/20, which became effective Feb. 1, 2021. The order incorporated 29 provisions similar to those in the Rules of Practice for the Commercial Division (Commercial Division Rules), see 22 N.Y.C.R.R. §202.70, into the Uniform Rules for The Supreme Court & The County Court. See 22 N.Y.C.R.R. §202; Siegel & Connors, New York Practice §3. The revised Uniform Rules addressed many important aspects of civil practice, including motions in general, and summary judgment motions in particular. See Patrick M. Connors, Riffing on Rules: The Recent Amendments to the Uniform Rules, N.Y.L.J., July 19, 2021, at 3, col. 1 (discussing status of revised rules and early caselaw applying them).

As discussed in our July 2021 column, significant concerns regarding the implementation of the revised rules were expressed by, among others, members of the New York State Bar Association (NYSBA). The NYSBA appointed a Task Force on the Uniform Rules, which issued a report on July 19, 2021 containing specific recommended changes to the Uniform Rules. The report was forwarded to the Office of Court Administration (OCA) for consideration on Aug. 6, 2021. On Oct. 1, 2021, OCA issued a memorandum containing suggested revisions to the revised Uniform Rules and inviting comments by Dec. 1, 2021.
