U.S. District Judge Nelson Román of the Southern District of New York on Tuesday granted Ally Bank’s motion to dismiss a proposed class action suit filed against the bank on behalf of customers whose usernames and passwords were reportedly leaked.

Ally, represented by Simpson Thacher & Bartlett partner Martin Bell and associates Rachel Sparks Bradley and Patrick Barry, argued that the leak was caused by an inadvertent coding error and the bank responded quickly and effectively, such that the plaintiff did not allege any actual injury.
