Second U.S. Circuit Judge Pierre Leval on Thursday appeared convinced that a Manhattan federal judge “put the burden on the wrong party” when she dismissed a lawsuit filed against the Turkish state-owned bank Halkbank by victims of terror attacks who have obtained judgments against Iran, but the other two members of the panel—Circuit Judges Joseph Bianco and Denny Chin—did not appear to be as certain.

Halkbank attorney John Williams of Williams & Connolly and plaintiffs’ attorney Robert Weigel of Gibson, Dunn & Crutcher appeared before the three-judge panel Thursday, with Weigel arguing that U.S. District Judge Denise Cote of the Southern District of New York erred by finding that Halkbank carried its burden to demonstrate that Turkey was an adequate forum for the suit.
