A defendant LLC entered into contract to sell certain real property to the plaintiff. The defendant owners of the defendant LLC had executed a property condition disclosure statement (PCDS) relating to a single-family home. A copy of the PCDS was allegedly given to the plaintiff prior to execution of the contract.

The plaintiff visited the property prior to execution of the contract. The plaintiff alleged that the home was “fully furnished.” However, alleged that “the lights/electricity in the basement were not working, as a result of which he was only able to observe the condition of the basement through a flashlight.”
