Attorneys for former Suffolk County District Attorney Thomas Spota and his former anti-corruption unit chief, Christopher McPartland, on Thursday asked a three-judge panel of the U.S. Court of Appeals for the Second Circuit for a reversal of conviction and new trial for the men, who are serving five-year prison sentences for obstruction of justice.

Alan Vinegrad of Covington & Burling, who represents 81-year-old Spota, argued that U.S. District Judge Joan Azrack of the Eastern District of New York was wrong to admit evidence of former Suffolk County Police Chief James Burke’s prior bad acts at trial.
