A Bronx-based lawyer representing his father’s estate in a lawsuit over injuries suffered by his late father did not violate professional conduct rules such as a lawyer acting as a witness or a lawyer communicating directly with an opposing party who has counsel, an appeals has court ruled.

Affirming a lower court, a panel of Appellate Division, First Department justices rejected a motion by Beth Abraham Nursing Home to disqualify attorney Roger Newyear as counsel for his father’s estate in the case.
