Riverkeeper’s 2020 lawsuit alleged defendants’ discharge of polluted industrial stormwater from their industrial park into Coeymans Creek contrary to the Clean Water Act and the New York State Department of Environmental Conservation State Pollutant Discharge Elimination System MultiSector General Permit for Stormwater Discharges Associated with Industrial Activity (General Permit).

The complaint’s eight claims asserted, among other things, unlawful discharge of pollutants, and failure to develop, implement, and make available a stormwater pollution prevention plan (SWPPP) in accordance with the General Permit, both contrary to 33 USC §§1311 and 1342.
