A Manhattan Supreme Court judge has dismissed and sealed the case against an ex-NYPD detective accused of perjury, following allegations of prosecutorial misconduct by the defense.

Defense attorney Howard Tanner on Tuesday made a motion to dismiss the charges against his client Joseph Franco, claiming that prosecutors had failed on three separate occasions to turn over evidence.
