Praemonitus Praemunitus, or forewarned is forearmed, are words to live by in custody litigation. As someone who has served as Attorney for the Child (AFC) in the New York County Family and Supreme Courts, it often surprises me how little awareness counsel for parents have about the importance of the in-camera interview, and how little they prepare their clients for it.  If counsel hopes to achieve the best results for their clients in custody litigation, understanding what goes on at these confidential meetings between the jurist and the children is essential.

In their battle to “win” in family litigation, the adverse impact upon the most important parties to the case, the children, often goes unnoticed by their parents. Fortunately, the court always has its eye on the children.  Assigning an AFC is the primary tool in the court’s toolbox, but the in-camera Interview comes in as a close second in terms of importance.
