Plaintiffs, high-level officials in the New York City Fire Department (FDNY), were recently demoted or reassigned.

Their state court lawsuit claimed entitlement to an Article 78 proceeding compelling reinstatement to their former positions and responsibilities, and their entitlement under 42 USC §1983 and the Fourteenth Amendment’s Due Process Clause to a name-clearing hearing and a declaration of their constitutional rights’ violation.
