Plaintiff Erica Bernhard, the owner of a company specializing in art installations and new media arts, applied for a job with Google and was interviewed by defendant Adam Katz, Google’s creative lead at its internal marketing agency.

Bernhard claimed Katz tried to pursue a personal relationship with her and dangled projects over her while saying he could not work with her since he was attracted to her. Bernhard was ultimately not hired by Google and sustained a loss in the value of the contracts for which Katz was purportedly going to hire her.
