After hearing oral arguments Tuesday, a three-judge panel of the U.S. Court of Appeals for the Second Circuit is set to consider whether to reverse the dismissal of bribery and fraud charges in former New York Lt. Gov. Brian Benjamin’s indictment in a public corruption case.

U.S. District Judge J. Paul Oetken of the Southern District of New York partially granted Benjamin’s motion to dismiss his indictment in December, ruling that Manhattan federal prosecutors failed to allege an explicit quid pro quo in Benjamin’s interaction with Harlem real estate developer Gerald Migdol.
