Under Election Law §16-102 petitioners sought to invalidate a petition designating Ugell as the Republican Party’s nominee as a candidate for Supervisor of the Town of Clarkstown in the June 2023 primary election.

State supreme court granted the petition after finding Ugell ineligible, under Election Law §6-122, to be a candidate for office as Town Supervisor because he then held the position of Town Justice. The court also concluded the petitioning process was permeated with fraud.
