Plaintiffs brought an action to recover damages for wrongful death for a Times Square hotel’s alleged negligence in failing to timely contact the police—despite promising to do so—after having been informed that plaintiffs’ decedent committed suicide while staying there as a guest.

Plaintiffs alleged that defendants’ 25-minute delay in calling the police, and their inability to gain immediate access to the decedent’s room when the police finally arrived, contributed to the decedent’s committing suicide when he jumped from his 11th-floor hotel room window in 2017 at the TRYP by Wyndham New York City Times Square South at 345 W. 35th Street.
