Defendants entered into a contract to buy an apartment from plaintiffs, and paid a deposit of $449,500.
Plaintiffs, who claimed defendants failed to buy the apartment by the agreed-upon closing date, sued for anticipatory repudiation seeking release of the deposit to them as their liquidated damages under the contract.
