A New York trial court judge on Monday declared the state's 14-month-old ethics panel unconstitutional, stripping the new body of its investigative and enforcement authority, in a preliminary legal win for former New York Gov. Andrew Cuomo.
State Supreme Court Justice Thomas Marcelle of Albany County wrote that Democratic lawmakers seemingly tried to create a fourth branch of government, with a vetting process reliant on law school deans.
