An alumnus made a $1.8 million gift to upgrade and maintain the Dartmouth College golf course. The college subsequently closed the course in July 2020, as it was too expensive to maintain.

Then, in August 2021, Dartmouth sought judicial approval to modify ("repurpose") "certain restrictions on the permissible use" of the alum's gift.

The donor's will, drawn and probated after his lifetime gift, provided that if Dartmouth didn't use his gift to upgrade and maintain the golf course, the unspent funds (with a current value of $3.8 million) were to be paid to his foundation supporting children in need.
