The New York City Department of City Planning (DCP) has proposed a set of changes to the Zoning Resolution intended to facilitate economic growth by amending certain outdated and ambiguous zoning regulations. The proposed zoning text amendment, known as “City of Yes for Economic Opportunity” (the “Zoning Text”), is one of three citywide zoning proposals from the Adams administration. The first, “City of Yes for Carbon Neutrality,” was adopted by the City Council on Dec. 6, 2023. “City of Yes for Housing Opportunity” is expected to enter public review in Spring 2024.

The Zoning Resolution governs land use across New York City, including the permitted size and configuration of buildings and their permitted uses. The current Zoning Resolution was originally adopted in 1961. Although it has been amended countless times, the Zoning Resolution has not kept pace with many changes in the city’s economy. DCP developed the Zoning Text to respond to the city’s evolving economy and foster vibrant neighborhoods.
