Alleging discrimination and retaliation under Title VII of the Civil Rights Act and the New York State Human Rights Law, plaintiff Jada Winters claimed that she was repeatedly sexually harassed by cross defendant Patrick Cooley and that defendant Phountain PH Holdings later fired her for tardiness, no-shows, phone use, and a reference to “the TikTok stuff” that plaintiff did not understand as support.

District court granted Phountain’s counsel Diana Seo’s motion to withdraw representation, but denied Winters’ motion to compel depositions from Phountain and to sanction Phountain for failing to appear at a prior deposition. Seo had been unable to communicate with Phountain since September 2023. Also, Phountain refused to pay its bill. Both are reasons for permissive withdrawal.
