Regarding Brian Lee's Jan. 23 article "Vacancies, Politics May Cloud Future of NY Commission on Judicial Nomination," filling current and upcoming vacancies on the Commission on Judicial Nomination and addressing the question of whether to modify the state constitutional provision that establishes the Commission are not mutually exclusive.

In the event there is another unexpected vacancy on the New York Court of Appeals, the constitution is our guiding document, unless and until there is an amendment that passes two separate legislative sessions and gains the support of New York voters on the ballot.
