The 2023–2024 term of the Court of Appeals has seen a large uptick in the number of appeals decided by the court as compared to previous terms. This is especially true as to decisions deciding important and significant evidence issues. Several of these decisions have been previously discussed – Matter of Appellate Advocates, 40 NY3d 547 (2023) in “Attorney Client Privilege,” NYLJ, 4/4/24, p. 3, col. 3, and People v. Ortega, 40 NY3d 463 (2023) and People v. Jordan, 40 NY3d 396 (2023) in “Court of Appeals Revisits Bruton and Crawford Rules,” New York Law Journal, Dec. 7, 2023, p. 3, col. 3.

In this column, and in my next, the other decisions addressing evidence issues will be discussed. While they arise in the context of a criminal action, they also have applicability in civil actions.
