A three-judge panel of the U.S. Court of Appeals for the Second Circuit on Monday affirmed a Manhattan federal judge’s ruling dismissing lender liability claims against Gamma Real Estate Capital in connection with a planned multibillion-dollar real estate development near Dallas.

The plaintiffs—entities connected to the real estate development known as Wade Park—sued Gamma in Georgia federal court in 2020, claiming breach of contract, fraud and other allegations; the case was later transferred to New York.
