A well-known upstate New York lawyer has been disbarred after practicing for 58 years, but through the rare occurrence of a two-justice dissent, when the attorney in question agreed to have his name stricken from the Empire State’s roll of attorneys while facing a slate of misconduct charges having to do with bad bookkeeping.

E. Stewart Jones Jr. had stipulated to the disbarment as he resigned while facing nine charges of professional misconduct stemming from allegations he misappropriated client funds at his former law firm, according to a split, 3-2 ruling out of the Appellate Division, Third Department on Thursday.
