After unsuccessful insertion of a heart stent in 2008 at Westchester Health Care Corp. and the Westchester Medical Center (collectively WMC) plaintiff’s decedent was treated for congestive heart failure, which included a left ventricular assist device, in 2011 at Yale-New Haven Hospital, where he died from complications.

The administrator of the decedent’s estate filed suit against WMC in 2013, alleging medical malpractice and wrongful death. Following a 2017 trial, a jury awarded plaintiff more than $3.6 million, which included $1 million for decedent’s pain and suffering and an additional $1 million for emotional pain characterized as “pre-impact terror.”
