Allan Applestein and his company sued law firm Wachtel Missry LLP and Wachtel partner Howard Kleinhendler for legal malpractice in connection with the 2017 sale of a 1,000-acre parcel in Virginia to the Virginia True Corp.

Kleinhendler organized a group of investors to purchase the property. But Applestein—whose health went into steep decline in 2015 and who was ultimately diagnosed with Alzheimer’s—and his company allege that Kleinhendler took advantage of Applestein’s deteriorating mental state.
