A New York federal judge on Tuesday declined to set aside a partial verdict for the state Attorney General’s Office against the Wisconsin-based makers of Prevagen, a significant order that affirms the attorney general’s broad authority to investigate and regulate repeated acts of fraud.

U.S. District Judge Louis L. Stanton, of the U.S. District Court for the Southern District of New York, did so by upholding a May jury verdict that had found that Quincy Bioscience Holding Co., the maker of Prevagen, a dietary supplement claiming to improve memory loss, had the capacity or tendency to deceive under New York Executive Law §63(12).
