On July 30, 2024, the New York State Attorney General’s Office (OAG) announced guidance on the use of website privacy controls and tracking on the web.  The guidance took the form of two separate, on-line guides, one directed at businesses, addressing efficacy and clarity of cookie and tracking choices on commercial websites, and the other directed at consumers, addressing the various types of tracking that occur on the web and how to limit such tracking.

The OAG’s business guide highlights the increasing risks surrounding website tracking activities and the efforts businesses should undertake to appropriately manage those risks.
