The federal Bureau of Prisons has instructed staff not to designate a defendant to a notorious Brooklyn facility after a judge threatened to vacate the man’s nine-month sentence in the event he were sent to the “inhumane” facility, according to a new filing.

U.S. District Court Judge Gary Brown made headlines last month when he ruled he would re-sentence Daniel Colucci to home confinement if the 74-year-old were sent to the Metropolitan Detention Center.
