Plaintiff brought an action arising out of alleged employment discrimination and retaliation on the basis of sexual orientation and gender. Plaintiff, a former general manager of an Equinox fitness center, alleged that his supervisor made numerous inappropriate comments to plaintiff about his body and sexuality.

Plaintiff alleged that after he complained of the behavior, he was subjected to negative treatment and was terminated shortly thereafter. Plaintiff’s complaint asserted causes of action against defendants for discrimination, aiding in discrimination, vicarious liability, retaliation, and hostile work environment. Defendants moved for summary judgment. The motion was denied to one defendant and granted to another.
