Petitioner sought an order directing the respondent, the Brooklyn District Attorney's office, to produce all documents and records relating to the arrest, investigation and prosecution of petitioner in the case of People v. Michael Cobb and awarding petitioner's counsel his legal fees and expenses.

Brooklyn Supreme Court Justice Francois Rivera granted the petition to the extent that, the prosecution was directed to submit to the court the attorney notes claimed to fall with the intra-agency exemption and unredacted copies of the redacted records and any documentation supporting the privacy exemptions relied upon for the redactions; conduct a diligent search of its records, and the unredacted records and any applicable certifications which must be delivered to chambers under specific instructions.
