Probably even the most extreme death penalty abolitionist would almost be okay with KSM being that exception who warrants the death penalty. As the alleged "mastermind" of 9/11, presumably only one step below Osama bin Laden himself, most Americans believe that KSM well-deserved the significant waterboarding torture and existence in a coffin-like venue, if you will, for extensive periods of time that he was forced by his interrogators to endure. Not to mention the substantial number of years of pre-trial detention he has experienced under extreme conditions at Guantanamo. That, while awaiting either a trial or a guilty plea—a potential death sentence hanging over him throughout.
