U.S. District Judge Lawrence Khan of the Nothern District of New York dismissed veteran educator Keith Schiebel's claim that defendant Schoharie Central School District discriminated against him on the basis of sex, in violation of Title IX of the Civil Rights Act, by conducting a Title IX investigation that found he sexually harassed a female student when he reached around her to retrieve supplies from a cabinet.

The U.S Court of Appeals for the Second Circuit reversed, and remanded, the district court's judgment. Writing for a three-judge panel, Circuit Judge Steven Menashi said the court found that Schiebel's complaint plausibly stated a Title IX claim under either of two theories.
