Every lawyer who ever litigated a case knows that a motion is an application for an order and that a motion on notice is made when a notice of the motion or an order to show cause is served. (CPLR 2211)

An ex parte motion is a different species (Siegel, N.Y. Prac. §526 (6th ed.). The Civil Practice Law and Rules refer to a motion made without notice to the adverse party as an ex parte motion. An ex parte motion is "made" when the proposed order to show cause or proposed order, which is submitted with an affidavit in support of the motion, is signed by the court. (See CPLR 2211; Lombardi v. Lombardi, 190 A.D.3d 964, 140 N.Y.S.3d 264 (2d Dept., 2021).
