Counsel for President-elect Donald Trump are urging the judge overseeing their client's New York criminal case to dismiss the matter entirely, citing the Presidential immunity doctrine, the Supremacy Clause, and President Joe Biden's recent pardon of his son, Hunter.
"Yesterday, in issuing a 10-year pardon to Hunter Biden that covers any and all crimes whether charged or uncharged, President Biden asserted that his son was 'selectively, and unfairly, prosecuted,' and 'treated differently,'" reads the filing, which was made public on Tuesday.
