An important feature of non-party discovery in New York is the cost-shifting rule set forth in Section 3122(d) of the New York Civil Practice Law and Rules (CPLR). Under CPLR 3122(d), a non-party’s reasonable costs for producing documents in response to a non-party subpoena must be reimbursed by the subpoenaing party.
