Plaintiff relators' qui tam action under the False Claims Act alleged that the HCL defendants (collectively HCL)—their former employer—defrauded the government by obtaining visas for foreign employees, primarily from India.
They allege that the fraud was carried out by defendants avoiding or decreasing its tax obligations by underpaying H-1B visa employees and by applying for less expensive visas for employees requiring H-1B visas.
