'Andrea v. Arnone': Dismissal for Failure to Prosecute

Ronald D. Bratt, the principal law clerk to Arthur M. Schack, Justice of the Supreme Court, Kings County and a senior instructor at Concord University School of Law, reviews a case in which a unanimous Court of Appeals decided that any dismissal that was caused by repeated disregarding of discovery directives is a dismissal for neglect to prosecute.
