Campbell v. Pesce, 60 NY2d 165

While a court may correct its own clerical error in accepting a plea or imposing sentence, after sentence has commenced a court that has accepted a plea in violation of the Criminal Procedure Law may not vacate the illegal plea and reinstate the original charges, the Court held.

Consolidated Edison Co. v. Town of Red Hook, 60 NY2d 99

The Court struck down a local law requiring a utility to obtain a town license before beginning a site study for a power plant, ruling that the Legislature had preempted local governments in regulation of the plant-siting process.

People v. Smith, 63 NY2d 41

The Court decided in the case of Lemuel Smith that the state’s mandatory death penalty for the murder of a prison guard by a life-term inmate was unconstitutional.

In re Anthony M., 63 NY2d 270

The Court held that medical evidence was sufficient to support a juvenile being found responsible for the death of an elderly woman who suffered a heart attack not long after the youth snatched her purse.

Dental Society v. Carey, 61 NY2d 330

The Court set out the principles governing when an organization has standing to bring an action in a case involving the state Dental Society’s challenge to state Medicaid reimbursement rates.

Gaeta v. New York News, 62 NY2d 340

Since the challenged statements in a defamation case against the newspaper were reasonably related to matters in the legitimate public interest, plaintiffs were required by the Court to prove that the newspaper had acted in a grossly irresponsible manner. The judges found the plaintiffs failed to meet that burden.

People v. Class, 63, NY2nd 491

The Court held that a police officer must have some legal justification for reaching into an automobile without a driver’s consent to move papers on the dashboard to read the vehicle identification number.
