Martin Act

In Caboara v. Babylon Cove Dev., LLC,2 this court considered whether the plaintiffs’ causes of action to recover damages for common-law fraud and breach of contract were preempted by the Martin Act because the allegations giving rise to the causes of action would support a Martin Act violation, and the enforcement of the Martin Act is vested exclusively in the Attorney General of the State of New York.
