ESTATE OF JOHN J. DENOIA, Deceased (0389/98)—This is an application by the administrator, decedent’s son, to distribute from his attorneys’ escrow account the proceeds of wrongful death and conscious pain and suffering causes of action settled in the Supreme Court, New York County before a Special Master. The causes of action arose from the decedent’s exposure to asbestos.
The proceeds are allocated 90 per cent to the cause of action for conscious pain and suffering and 10 per cent to the cause of action for wrongful death. The restrictions contained in the letters issued to the administrator are removed and he is authorized to collect the settlement and execute the necessary receipts and releases with respect to defendants United States Gypsum Trust and Celotex Corporation; the restrictions shall remain in full force and effect with regard to any remaining defendants.
