A bar panel is recommending a broad array of “due process improvements” to proceedings of the Commission on Judicial Conduct “to reduce the danger that the Commission may unintentionally compromise the independence of the judicial process.”
Among suggestions advanced by the Task Force on Judicial Independence of the New York County Lawyers’ Association “to enhance the fairness” of the commission’s work are providing to judges more and earlier information about commission inquiries, state-funded legal representation for judges appearing before it and a higher standard of proof for the determination of wrongdoing.
